Yummerz — Terms of Service
Welcome to Yummerz. These terms explain how the app works and what we ask of each other. They're written to be read, not skimmed past. By tapping “i agree” during setup you accept these terms, so please actually read them — they're short.
“Yummerz,” “we,” “us,” and “our” mean the operator of the Yummerz app: Joshua Yeung, the app's builder and operator.
1. What Yummerz is
Yummerz is a small, private, food-only social app. You share photos of what you're actually eating with friends you choose. There are no follower counts, no public profiles, no leaderboards, and no diet judgments.
Two things are worth understanding before you join:
- The feed is always open. There's no gate — you don't have to post anything to see your friends' meals, and nothing is ever locked behind a post.
- Posting is voluntary, and easy. Two-tap capture makes it quick, a diary-framed streak keeps track of the days you've shared, and optional reminders — off until you set your own times in Settings — go quiet once you've posted that day or marked a rest day. Streaks are for fun. You can mark a rest day any time from your profile; rest days don't break a streak, and nothing bad happens when one ends. Every notification can be turned off in Settings.
2. Who can use Yummerz
You must be at least 13 years old to create an account. We ask your date of birth at signup solely to check this; it's never shown to anyone else.
- If we learn a user is under 13, we delete the account and its data immediately.
- If you're 13–17, your account is private by default, your data is never used for advertising, and extra protections described in the Privacy Policy apply. A parent or guardian should read these terms with you.
You also need an Apple ID (Yummerz uses Sign in with Apple) and you agree to keep your account to yourself — no sharing logins, no impersonating anyone.
3. Your license to use the app
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use Yummerz on Apple devices you own or control. This license is for your personal, non-commercial use. It doesn't include the right to copy, sell, sublicense, decompile, reverse-engineer, scrape, or build derivative works from the app.
4. Your content
4.1 You own it
You own the photos, captions, comments, and reactions you post (“your content”). Nothing in these terms transfers that ownership to us.
4.2 The license you give us
To run the app, we need your permission to handle your content. By posting, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, resize, and display your content — solely to operate the app and show your content to the audience you chose (community, one friend, or just you), including through the infrastructure providers who host our service.
This license ends when you delete the content or your account, except for the limited retention described in the Privacy Policy (for example, content preserved in a moderation record). We will never use your photos in advertising or marketing without asking you first, separately and explicitly.
4.3 Your responsibilities
Only post content you have the right to share. If a photo includes other people, make sure they're okay with it. You're responsible for what you post.
5. Calorie estimates are not medical advice
Yummerz has an optional, off-by-default feature that shows a rough calorie and macro estimate for a meal photo.
- Estimates are produced by an automated image-analysis service and are approximate — often meaningfully wrong. They exist for curiosity, not counting.
- Estimates are not medical, nutritional, or dietetic advice, and Yummerz is not a medical device, diet program, or health service. Don't use estimates to make decisions about your health, medication, or eating. For that, talk to a qualified professional.
- Yummerz deliberately has no calorie goals, targets, deficits, warnings, or judgments, and never will.
- If numbers near food aren't good for you, leave the feature off — or turn it off any time in Settings → calories → off, which removes estimates from your experience entirely. If your relationship with food or eating feels like a struggle, please reach out to someone you trust or a professional resource such as the National Alliance for Eating Disorders helpline (1-866-662-1235) in the US.
6. Reporting, blocking, and moderation
If you see something that doesn't belong, long-press any post, comment, or profile and choose report. Every report goes to a human.
- We review every valid report and act within 24 hours. Content that violates these terms is removed, and the responsible account may be suspended or terminated.
- You can block any user at any time. Blocks apply both directions, immediately: neither of you sees the other's content.
- Abusing the report tool (spam or bad-faith reports) is itself a violation.
We reserve the right — but don't assume an obligation — to review, remove, or decline to display any content that we believe violates these terms or the law. Every moderation action is recorded in an append-only log. If your content is removed or your account is actioned and you think we got it wrong, email help@yummerz.app with “appeal” in the subject — a human reviews every appeal and answers within 5 business days.
7. Prohibited conduct
Yummerz is a food app, and almost everything you'd naturally post here is welcome — the good meals, the sad desk lunches, the 1 a.m. cold pizza. The rules below exist for the rare rest, and we apply a zero-tolerance standard to them.
7.1 Content rules (zero tolerance)
Never post, share, or transmit content that:
- is sexually explicit or pornographic, or sexualizes minors in any way — content sexualizing minors is reported to the National Center for Missing & Exploited Children (NCMEC) and law enforcement as required by law;
- depicts or incites real-world violence, or promotes self-harm, disordered eating, or harm to others;
- harasses, bullies, or targets any person, or attacks people based on race, ethnicity, religion, sex, gender identity, sexual orientation, disability, national origin, or any other protected characteristic;
- infringes someone else's intellectual property, privacy, or other rights;
- contains malware, phishing material, or other malicious code;
- is illegal under applicable law or facilitates illegal activity.
A single violation can result in immediate, permanent removal of the content and the account, without warning.
7.2 Behavior rules
Also off-limits:
- accessing, scraping, or indexing the app or its data by automated means;
- circumventing authentication, access controls, visibility settings, or rate limits;
- impersonating another person or misrepresenting who you are;
- spam, solicitation, or advertising;
- interfering with the app's operation or other users' access.
8. Account termination and deletion
You can leave any time. Delete your account from Settings → account → delete account. Deletion removes your posts and photos from friends' feeds immediately and permanently deletes your personal data — profile, birthdate, photos, posts, comments, reactions, nutrition entries, and activity records — within 30 days. A few records are kept longer where the law requires it (moderation and safety records, terms-acceptance records); the Privacy Policy lists exactly what and for how long.
We can also end accounts. We may suspend or permanently terminate your account, without prior notice, if we determine you've violated these terms or the law, or that your continued access puts other users at risk. On termination your license to use the app ends immediately.
9. Privacy
Our Privacy Policy — available in the app at Settings → legal → privacy policy and at https://yummerz.app/privacy — explains what we collect, why, who can see it, and your rights over it. The short version: we collect only what the app needs, we don't sell your data, we run no ads, and your photos are shared only with the people you choose. The Privacy Policy is part of these terms.
10. Our intellectual property
The Yummerz app, its design, code, name, logo, and everything we provide (other than your content) belong to us and are protected by intellectual property law. These terms don't give you any right to use the Yummerz name or branding.
11. Copyright complaints (DMCA)
If you believe content on Yummerz infringes your copyright, send a notice under the Digital Millennium Copyright Act (17 U.S.C. § 512) to our designated agent:

Your notice must include: identification of the copyrighted work, the URL or in-app location of the infringing material, your contact information, a good-faith statement that the use is unauthorized, a statement under penalty of perjury that your notice is accurate and you're authorized to act, and your physical or electronic signature. We remove infringing content promptly, notify the poster, and accept counter-notices. Repeat infringers' accounts are terminated.
12. Disclaimers
Yummerz is a free app run with care, but it's provided “as is” and “as available,” without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We don't promise the app will be error-free, uninterrupted, or that content (including calorie estimates — see §5) will be accurate. You use the app at your own discretion.
13. Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages — including lost data, lost profits, or emotional distress — arising from your use of, or inability to use, the app, even if we've been advised such damages are possible.
To the same fullest extent, our total aggregate liability for all claims arising out of these terms or the app will not exceed the greater of US $100 or the amount you paid us in the twelve months before the claim (today Yummerz is free, so that amount is zero).
Some jurisdictions don't allow certain warranty disclaimers or liability limits. Where the law gives you rights that can't be waived — including mandatory consumer-protection rights — nothing in §12 or §13 takes them away.
14. Indemnification
If someone brings a claim against us because of content you posted or something you did in violation of these terms or the law, you agree to indemnify us — that is, cover the losses and reasonable legal costs that result. This doesn't apply to the extent the claim results from our own breach of these terms.
15. Governing law and disputes
Talk to us first: most problems can be fixed with an email to help@yummerz.app, and we commit to responding within 7 days and working in good faith for 30 days before either of us starts a formal dispute.
These terms are governed by the laws of the jurisdiction where the app's operator resides, without regard to conflict-of-law rules, and disputes not resolved informally will be brought in the courts of that jurisdiction. Either of us may always bring an individual claim in small-claims court. If you're in the European Union or United Kingdom, the mandatory consumer laws of your country of residence continue to apply.
16. Changes to these terms
We may update these terms as the app evolves. When we make a material change, we'll bump the version number at the top, notify you in the app, and ask you to re-accept before continuing. Each account's acceptance (version and timestamp) is recorded. If you don't agree to updated terms, you can delete your account (§8) — that's a real option, not a legal fiction, and your data goes with you.
17. The Apple bits
These terms are between you and us — Apple is not a party to them and has no responsibility for the app or its content. However, you and we both acknowledge that Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use of the app must also comply with the Apple Media Services Terms and Conditions, including the Licensed Application End User License Agreement's usage rules.
18. Everything else
If a court finds part of these terms unenforceable, the rest still applies. Our not enforcing a term isn't a waiver of it. These terms plus the Privacy Policy and Community Guidelines are the whole agreement between us about the app. You may not assign these terms; we may assign them to a successor entity that commits to honoring them (for example, on incorporation — see the operator note at the top).
